Terms of Service

These Terms of Service (“Terms”) set out the conditions under which Dash to Cart (“Dash to Cart”, “we”, “us”, or “our”) provides its services to users, merchants, and customers (“users”). By accessing or using the Dash to Cart platform, you agree to be bound by these Terms.

1. Account Registration and Responsibilities


1.1 You must create an account with accurate and complete information. You are responsible for safeguarding your login credentials and all activities that occur under your account.

1.2 You must not share your login credentials with others or permit unauthorised access to your account.

1.3 Dash to Cart may suspend or terminate accounts that violate these Terms, breach security rules, or engage in unlawful or harmful activities.

2. Personal Data We Collect


2.1 “Personal data” means information that can identify an individual, directly or indirectly. This may include:

  • Name, gender, and contact information

  • Transaction and payment details

  • Device data such as IP address, browser type, and location

  • Behavioural and interaction data collected through your use of the platform

 

3. How We Collect and Use Personal Data

 

3.1 We collect personal data:

  • Directly from you during account creation, checkout, or service interactions

  • Automatically through cookies, analytics tools, and tracking technologies

3.2 We use your personal data to:

  • Process orders, manage payments, and maintain your account

  • Provide customer support and resolve issues

  • Improve and personalise your experience

  • Send marketing updates, product tips, promotions, and community content (opt-out available anytime)

  • Comply with legal, regulatory, and security obligations

4. User-Generated Content


4.1 Users may upload content such as images, product descriptions, logos, or reviews. By submitting such content, you grant Dash to Cart a non-exclusive, royalty-free, worldwide licence to use, host, display, and distribute it for platform operations, promotion, and service optimisation.

4.2 You are solely responsible for ensuring that content complies with applicable laws and does not infringe intellectual property, privacy, or other rights.

5. Prohibited Activities


5.1 Users must not engage in:

  • Selling illegal, counterfeit, or restricted goods

  • Misleading customers or misrepresenting products

  • Fraud, money laundering, phishing, or high-risk transactions

  • Uploading malicious code or attempting to bypass platform security

  • Infringing intellectual property rights

  • Any activity that harms the platform’s integrity or other users

5.2 Dash to Cart may suspend or terminate accounts found to be engaging in prohibited activities.

 

6. Payment, Fees and Disputes

 

6.1 Dash to Cart uses Stripe as its integrated payment gateway. By using the platform, you agree to Stripe’s terms of service.

6.2 All customer payments are processed securely through Stripe. Dash to Cart does not store credit card information.

6.3 Platform fees, including subscription fees or transaction fees, are displayed during onboarding. Fees are non-refundable unless stated otherwise.

6.4 Payment Disputes & Chargebacks

  • A chargeback occurs when a customer requests a refund from their bank.
  • Merchants are fully responsible for managing and resolving chargebacks.
  • Stripe may charge a dispute fee (typically USD $15–$25), payable by the merchant if the dispute is lost.
  • Dash to Cart is not liable for revenue loss, fees, or penalties arising from disputes.

6.5 Fraud Prevention & Risk Management

  • Dash to Cart uses Stripe Radar and additional risk tools to detect suspicious activity.
  • Merchants must take reasonable actions to prevent fraud, including:
    • Enabling CVV and address verification
    • Verifying customer identities for high-value orders
    • Using tracked delivery for physical items
    • Monitoring unusual purchasing patterns
  • If a merchant’s chargeback rate exceeds 1%, Dash to Cart may: 

    • Place temporary holds on transactions
    • Request additional verification or documentation
    • Limit payment features
    • Suspend or terminate the merchant’s account if fraud is suspected
6.6 Success Fee and Billing Cycle
 

6.6.1 Certain subscription plans include a success fee charged on each completed transaction. The success fee is calculated as a percentage of the total order value (excluding shipping fees) and is automatically deducted at the point of sale.

6.6.2 Success fees accumulated by merchants are billed every 2 weeks. Merchants must pay this bi-weekly invoice to keep their store active.

6.6.3 If a merchant fails to complete the bi-weekly success fee payment within the stated due date:

• The store may be temporarily paused or restricted
• Checkout may be disabled until payment is made
• Dash to Cart may apply late payment actions, including reminders or temporary limits on new orders

6.6.4 Success fees are non-refundable, including when orders are cancelled, refunded, or disputed, unless otherwise specified.

6.6.5 The applicable success fee rate will be displayed clearly during onboarding and in the merchant dashboard, and may be updated with reasonable prior notice.

7. Refunds and Returns Policy


7.1 Dash to Cart provides the technology for transactions, but does not handle refunds or returns.

7.2 Merchants must publish clear refund/return policies and comply with consumer protection laws.

7.3 Dash to Cart may assist in dispute mediation but is not liable for merchant refund obligations.

8. Limitation of Liability


8.1 Dash to Cart is not responsible for product quality, legality, safety, or claims arising from items sold by merchants.

8.2 To the fullest extent permitted by law, Dash to Cart’s liability is limited to the total platform fees paid by you in the 12 months before the claim.

8.3 We are not liable for indirect, consequential, incidental, or punitive damages.

 

9. Intellectual Property Rights

 

9.1 Dash to Cart owns all rights to its software, branding, AI tools, analytics, designs, and platform materials.

9.2 Users must not copy, reverse-engineer, distribute, or modify any part of the platform without written permission.

 

10. Termination of Services

 

10.1 We may suspend or terminate accounts that violate these Terms, fail to pay fees, risk platform security, or engage in fraud.

10.2 Upon termination, all outstanding fees remain payable.

10.3 When your subscription or account ends:

  • All store data, including products, assets, orders, customers, analytics, and settings, will be permanently deleted.
  • You are responsible for backing up your data before closure. Dash to Cart cannot recover deleted data.

11. Governing Law and Jurisdiction


11.1 These Terms are governed by Singapore law. Disputes will be resolved exclusively in Singapore courts.

 

12. Platform Role

 

12.1 Dash to Cart acts only as a technology provider and transactional facilitator.

12.2 Merchants are solely responsible for their products, fulfilment, pricing, and compliance with applicable laws.

13. Force Majeure


13.1 We are not liable for delays or service interruptions caused by events outside our control, such as natural disasters, cyberattacks, power failures, or government restrictions.

 14. Indemnification

 

14.1 You agree to indemnify Dash to Cart against claims, damages, losses, or expenses arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your breach of laws or third-party rights

15. Data Security and Retention


15.1 We adopt administrative, physical, and technical safeguards aligned with recognised cybersecurity standards to protect personal data. No system is completely risk-free, but we take reasonable steps to reduce exposure.

15.2 Personal data will be retained only for business, legal, or regulatory purposes.

16. Data Ownership and Transfers

 

16.1 Merchants retain ownership of their customer data, order history, and business information.

16.2 Dash to Cart may use aggregated and anonymised data for analytics, platform optimisation, fraud detection, and benchmarking.

17. Access and Correction

 

17.1 You may request access to or correction of your personal data by contacting our Data Protection Officer (DPO). Verification may be required.

18. Withdrawal of Consent


18.1 You may withdraw consent for data use by writing to us. Withdrawing consent may prevent us from providing certain services.

19. Changes to Terms of Service


19.1 Dash to Cart may revise these Terms from time to time.

19.2 Significant updates will be notified via email or platform notice. Continued use of the service constitutes acceptance of revised Terms.
