This Terms of Service (“Terms”) outlines the conditions under which Dash to Cart (referred to as “Dash to Cart”, “we”, “us”, or “our”) provides its services to users, merchants, and customers (“users”). By accessing or using Dash to Cart’s platform, you agree to these Terms.

1. Account Registration and Responsibilities


1.1 To use our platform, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and all activities conducted through your account.


1.2 You agree not to share your account credentials with others or allow unauthorised access to your account.


1.3 Dash to Cart reserves the right to suspend or terminate accounts for non-compliance with these Terms or any unlawful activities.

2. Personal Data We Collect


2.1 "Personal data" refers to information that can identify an individual, directly or indirectly. This may include:

  • Personal details such as name, gender, and contact information (email, phone number, postal address).

  • Transaction details including your purchase history and payment methods.

  • Device data, including IP address, device ID, and location data.

  • Activity data collected from your interactions with our platform (browsing behaviour, account interactions).

3. Collection and Use of Personal Data


3.1 We collect personal data:

  • Directly from you when you create an account, make a purchase, or engage with our services.

  • Automatically through cookies, browser tracking, and similar technologies.


3.2 We may use your personal data for the following purposes:

  • To process orders, manage payments, and maintain your account.

  • To provide customer support and address inquiries.

  • To personalise and improve your experience on our platform.

  • To send you marketing communications, such as tips, updates, promotions, and community-related content for merchants, buyers, and browsers. You can opt out of these communications at any time by using the unsubscribe link provided in our emails.

  • To meet legal and regulatory requirements.

4. User-Generated Content


4.1 Users may upload content such as product descriptions, images, or reviews. By submitting content, you grant Dash to Cart a non-exclusive, royalty-free, worldwide license to use, display, and distribute the content for platform operations and marketing.


4.2 Users are solely responsible for ensuring that the content complies with applicable laws, does not infringe third-party rights, and is not illegal, defamatory, or offensive.

5. Prohibited Activities


5.1 Users are prohibited from engaging in the following activities:

  • Selling illegal, counterfeit, or prohibited goods.

  • Misleading customers through false advertising.

  • Engaging in fraudulent transactions or phishing attempts.

  • Uploading harmful software or violating the platform’s security.

  • Violating intellectual property rights.


5.2 Dash to Cart reserves the right to suspend or terminate accounts engaged in prohibited activities.

6. Payment and Fees


6.1 Dash to Cart is fully integrated with Stripe for payment processing. By using our platform, you agree to Stripe’s terms and conditions.


6.2 All transaction payments are processed securely through Stripe. Dash to Cart does not store credit card information.


6.3 Platform fees, such as subscription or transaction fees, are clearly outlined during account setup and are non-refundable unless specified otherwise.

7. Refunds and Returns Policy


7.1 Dash to Cart facilitates transactions between merchants and customers but does not directly handle refunds or returns.


7.2 Merchants are responsible for establishing their own refund and return policies and ensuring they comply with applicable laws.


7.3 Dash to Cart may mediate disputes but is not liable for refund or return claims.

8. Limitation of Liability


8.1 Dash to Cart is not responsible for the quality, legality, or safety of products sold by merchants on the platform.


8.2 To the maximum extent permitted by law, Dash to Cart’s liability is limited to the total fees paid by you to us in the 12 months preceding the claim.


8.3 Dash to Cart is not liable for indirect, incidental, or consequential damages arising from your use of the platform.

9. Intellectual Property Rights


9.1 Dash to Cart retains all ownership rights to its platform, including software, designs, trademarks, and logos.


9.2 Users are prohibited from copying, modifying, or distributing any part of Dash to Cart’s intellectual property without prior written consent.


10. Termination of Services


10.1 Dash to Cart may suspend or terminate your account if you violate these Terms, engage in illegal activities, or fail to pay platform fees.


10.2 Upon termination, users must settle all outstanding fees and disputes. Dash to Cart reserves the right to delete user data following termination.


10.3 If your account or subscription ends, Dash to Cart will permanently delete all associated store data, including assets, customer information, and transaction history, from our systems. It is your responsibility to back up any data before termination, as Dash to Cart will not retain or recover deleted data

11. Governing Law and Jurisdiction


11.1 These Terms are governed by the laws of Singapore. Any disputes arising from these Terms will be resolved exclusively in Singapore courts.

12. Platform as an eCommerce Platform


12.1 Dash to Cart acts solely as a facilitator connecting merchants and customers. We are not the seller or buyer in any transaction.


12.2 Merchants are solely responsible for the products they sell and ensuring compliance with applicable laws.

13. Force Majeure


13.1 Dash to Cart is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, cyberattacks, government restrictions, or technical failures.

14. Indemnification


14.1 You agree to indemnify and hold Dash to Cart harmless from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your infringement of third-party rights.

15. Data Security and Retention


15.1 We take appropriate administrative, physical, and technical measures to protect your personal data from unauthorised access, loss, or misuse. However, no method of data transmission over the internet is completely secure.


15.2 We retain your personal data only as long as necessary for the purposes it was collected, or as required by law.

16. Data Ownership and Transfers


16.1 Merchants retain ownership of their customer data, sales data, and related information.


16.2 Dash to Cart may use aggregated, anonymised data for analytics and platform improvement.

17. Access and Correction of Personal Data


17.1 You can request access to, or correction of, the personal data we hold about you by contacting our Data Protection Officer (DPO) at the contact details below. We may require verification of your identity before fulfilling such requests.

18. Withdrawal of Consent


18.1 You may withdraw your consent to our collection, use, or disclosure of your personal data by notifying us in writing. Please be aware that withdrawing consent may affect your ability to use certain services on our platform.

19. Changes to Terms of Service


19.1 Dash to Cart reserves the right to update these Terms from time to time. Significant changes will be communicated to users via email or through the platform.


19.2 Continued use of the platform after changes indicates acceptance of the updated Terms.
